Article 8 – Customs, import duties, and VAT obligations
8.1
All goods offered and sold through this website are shipped under the delivery term "Delivered Duty Unpaid (DDU)" according to Incoterms 2000. This means the customer alone is fully responsible for all costs and obligations arising from the import of the goods into the destination country.
8.2
These obligations include, among others:
(a) Payment of import duties, value-added tax (VAT) or goods and services tax (GST), as well as other taxes or charges levied at the point of entry;
(b) Customs clearance costs, including all brokerage, inspection, or processing fees charged by customs authorities, postal services, or courier companies;
(c) Compliance with local laws, product regulations, restrictions, and required certifications in the country of delivery.
8.3
The seller (hereinafter "the entrepreneur") does not act as the importer of the goods. Legal ownership and responsibility for the goods transfer to the customer upon shipment. The entrepreneur is not liable for delays, seizures, rejections, or fines resulting from non-compliance with applicable import laws or the customer's failure to pay required fees.
8.4
The entrepreneur provides the necessary commercial documents for international shipping (including, if required, proforma or commercial invoice, product description, and declared value). However, they do not guarantee that the documentation or goods meet specific regulatory or technical import requirements of the destination country. The customer is solely responsible for checking whether the ordered goods are allowed, restricted, or require approval for import.
8.5
The customer agrees to indemnify the entrepreneur against all financial consequences, claims, penalties, or costs imposed by customs authorities or third parties due to the customer's non-compliance with applicable import regulations.
8.6
It is strongly recommended that customers contact their local customs authority or check the relevant import regulations before ordering to avoid unexpected fees, delays, or rejections at the border.
Article 9 – CESOP Compliance
Starting in 2024, payment service providers will register transaction data in the CESOP system (Central Electronic System of Payment Information) according to EU regulations. The entrepreneur complies with these regulations, which may affect the monitoring and reporting of payments.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products comply with the contract and legal requirements.
Defects must be reported in writing within 14 days.
Products must be returned in their original packaging and in their original condition.
Article 11 – Delivery
Orders will be delivered within 30 days unless otherwise agreed.
In case of delays, the entrepreneur will inform the consumer within 14 days of the order date.
The entrepreneur ensures shipping in accordance with international shipping regulations but assumes no responsibility for delays or issues with customs clearance.
The customer's failure to comply with import obligations does not constitute grounds for cancellation or refund of the order.
Article 12 – Complaint Procedure
Complaints must be submitted in writing within 7 days of identifying the problem.
The entrepreneur will respond to complaints within 14 days. If a longer processing time is required, an estimated deadline will be communicated.
Article 13 – Dispute Resolution
These General Terms and Conditions are subject to Dutch law. Disputes will preferably be settled amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.
